ADMINISTRATIVE RULES Michael R. Coveyou, Agency Rules Administrator The Iowa Administrative Procedure Act, Chapter 17A of the Code of Iowa, provides for the promulgation of administrative rules by state agencies. Administrative rules amplify, clarify, and implement statutory language found in the Code of Iowa. Administrative rules carry the force of law, and are codified in the Iowa Administrative Code. The Iowa Administrative Code is organized by issuing agency and each agency has an identifying number to uniquely label its rules. The Iowa Department of Public Safety's identifying number is 661. Consequently, Chapter 121 of the Department's administrative rules can be cited as "661 IAC Chapter 122." Current, Recent, and Anticipated Rulemaking The Department's annual Regulatory Plan, outlining rulemaking initiatives anticipated during State Fiscal Year 2010 (July 1, 2009 through June 30, 2010) was recently completed and filed. The Fire Marshal has adopted new rules for Commercial Explosive Licenses, which will take effect on January 1, 2010. The Fire Marshal has adopted updates to rules of the Fire Marshal which specify requirements for fire and life safety safeguards for various occupancies, which will take effect on January 1, 2010. The Fire Marshal has adopted updates to requirements for fire fighter certification, which will take effect on January 1, 2010. The Building Code Commissioner has adopted updates to the State Building Code which will take effect on January 1, 2010. The Building Code Commissioner has adopted updates to the State Historic Building Code which will take effect on January 1, 2010. Anticipated Rulemaking The Fire Marshal has proposed rules for licensing fire protection system installers and maintenance workers. These rules were anticipated to be filed and in effect on January 1, 2010, but will be delayed. |
