Current Rulemaking Activity

The Department's Administrative Rules Docket is the formal legal presentation of the status of rulemaking actions by the Department of Public Safety. It's format is not friendly to all potential users, in that it is primarily designed to meet legal requirements. This page supplements the docket with information regarding recent and upcoming rulemaking activities of the Department in a format which may be more useful to some of those interested in or affected by the Department's rules.

The information presented below is divided between recent and upcoming activities. Anyone with questions regarding this material or wishing to comment or participate in any of the upcoming activities may contact the Department via mail, phone (515-281-5524) or electronic mail (admrule@dps.state.ia.us).

Recent Activities/Actions

  • The Building Code Commissioner has adopted a new State Building Code, based, with some exceptions, on the adoption by reference of the International Building Codes and related codes. The new State Building Code takes effect on April 1, 2006.
  • The Building Code Commisisoner has also adopted a State Historic Building Code, which takes effect on April 1, 2006.
  • Revisions to the rules on the Iowa Sex Offender Registry have been adopted and are effective on January 1, 2006.
  • Rules governing the DNA Database administered by the Division of Criminal Investigation wereadopted emergency and effective July 1, 2005, and have also been published in a Notice of Intended Action. A public hearing on these rules was held on September 12, 2005.
  • The Fire Marshal has adopted rules establishing fire safety requirements for assembly occupancies and allowing compliance with the International Fire Code as an alternative to rules of the Fire Marshal, except for health care occupancies, in local jurisdictions which have adopted the International Fire Code and enforce it locally.
  • Rules enabling retail dispensing of ethanol blend fuels with greater than 10 percent concentrations of ethanol have been adopted by the Fire Marshal and were effective on October 1, 2005
