Applications for permits to carry weapons will be considered by the Iowa Department of Public Safety as follows:
1.

Professional permits to carry will only be issued to qualified applicants if their need to go armed is employment based and is a critical element in the protection of life and property. |
|
2. |
Nonprofessional permits to carry will only be issued
to: |
|
a.
|
nonresident correctional officers and other public officials, other than law enforcement officers*, who are currently employed fulltime in the administration of criminal justice |
b.
|
other nonresidents with a demonstrable viable threat to themselves or their family as verified by a law enforcement agency in the jurisdiction where the threat occurred |
|
* Law enforcement officers are not issued nonprofessional permits to carry because of their ability to carry nationwide pursuant to the Law Enforcement Officers Safety Act of 2004. |
|
| Application procedures - new and renewal |
|
|
|
a. |
submit a fully and accurately completed application |
b.
|
submit a certificate of completion of a training program that includes qualifying on a firing range within the past six months |
|
c. |
submit two completed fingerprint cards |
|
d. |
comply with the requirements of the Iowa Code |

comply with the requirements of the United States Code |

| Age - 21 years of age or older unless the applicant is a security guard or correctional officer. Permits may be issued to security guards or correctional officers who are 18, 19 or 20 years old for use while on duty. [§724.8; §724.22(4)] |
| Criminal Record |
1.
|
No conviction of a felony or any crime defined in chapter 708 except assault defined in §708.1 and harassment defined in §708.7. Those misdemeanor crimes in chapter 708 that disqualify an applicant include domestic abuse; hate crime; assault on a peace officer, fire fighter or health care provider; setting a spring gun or trap; hazing and stalking. |
2.
|
No conviction of any crime at any level that resulted from domestic abuse. For the purposes of this section, domestic abuse is defined to include child abuse. |
|
3. |
No conviction for any crime involving a firearm or explosive |
|
| Constitute danger to any other person |
|
1.
|
Not be subject to any court order (protective order), including a temporary order, that restrains the person from harassing, stalking, threatening or having cont act with any person |

Three or more convictions for misdemeanor assault and/or
battery |

battery in the past five years |

Three or more arrests for misdemeanor assault and/or
battery in the past five years if the most recent arrest occurred
in the past year |

4. |
Other multiple acts of violence as determined and documented
by the issuing officer |

Addiction to the use of a controlled substance may be
indicated by any of the following: |
|
a.
|
voluntary or involuntary committal to any in-patient
drug treatment program in the past three years |
|
b. |
two or more convictions for any crime involving a controlled
substance* in the past three years |
c.
|
three or more arrests for any crime involving a controlled
substance* in the past five years if the most recent arrest occurred
in the past year |
|
d. |
confirmed positive drug screen test in the past year |
e.
|
disciplinary action taken by any employer or organization
for use or possession of a controlled substance or a drug rehabilitation
failure in the past year |
|
|
2. |
The abuse of a controlled substance may be indicated
by any of the following: |
|
a.
|
voluntary or involuntary committal to any in-patient
drug treatment program in the past three years |
b.
|
voluntary or involuntary submission to any drug treatment
program in the past two years |
|
c. |
conviction for any crime involving a controlled substance*
in the past year |
d.
|
two or more arrests for any crime involving
a controlled substance* in the past five years if the most recent
arrest occurred in the past year
|
|
e.
|
police report or other criminal justice
documentation confirming the use of a controlled substance within
the past year |
|
f. |
confirmed positive drug screen test in the past year |
g.
|
disciplinary action taken by any employer or organization
for use or possession of a controlled substance or drug rehabilitation
failure in the past year |

Crime involving a controlled substance includes but is not limited to possession; use; delivery; intent to deliver; operating a motor vehicle under the influence; committing a criminal act while under the influence; and possession of drug paraphernalia. |
|
|
3. |
Addiction to the use of alcohol may be indicated by
any of the following: |
|
a.
|
voluntary or involuntary committal to any in-patient
alcohol treatment program in the past three years |
b.
|
two or more arrests, one of which resulted in a conviction,
for unlawful use or possession of alcohol or other criminal act committed
while under the influence of alcohol in the past year |
c.
|
three or more arrests, one of which resulted in a conviction,
for unlawful use or possession of alcohol or other criminal act committed
while under the influence of alcohol in the past five years if the
most recent arrest occurred in the past year |
d.
|
disciplinary action taken by any employer or organization
for unlawful use or possession of alcohol or alcohol rehabilitation
failure in the past year |
|
| Mental Disability - may be indicated by
any one of the following: |
|
1. |
Adjudged mentally incompetent at any time by any court |
|
2. |
Committed by any court to any mental institution |
|
3. |
Received inpatient treatment for any mental illness
in the past three years |
|
4. |
Received treatment by a health care professional for a serious mental illness or disorder which impairs a person's capacity to function normally and safely, both toward themselves and others. |
|

1. |
Not have been discharged from the Armed Forces under
dishonorable conditions |
|

Not be an alien illegally or unlawfully in the United
States |
3.

Not be a non-resident alien. Non-resident aliens can
qualify if legal status verified through the US INS, 90-day residency
is verified and the non-resident alien possesses a valid hunting license. |

|
| Training Requirements |
1.
|
Professional and Nonprofessional – Applicants for new professional and nonprofessional permits to carry are required to submit a completed form WP0 (Iowa Firearms Safety Training Program and Enrollment Certificate) that indicates completion of an approved course of instruction and to qualify on a firing range. Applicants for renewal professional and nonprofessional permits to carry are required to submit a completed form WP0 that indicates requalification on a firing range. |
2.
|
Peace Officer – Applicants for peace officer permits to carry meet the training requirements by completing the course of instruction as part of their Iowa Law Enforcement Academy certification. The peace officer certification date on the application form is all that is required. |
3.
|
Reserve Officer – Applicants for reserve officer permits to carry must submit the training certification from the Iowa Law Enforcement Academy that indicates the employing agency, the weapon types for which they have been certified and the certification date.
|
|
Restrictions
The restriction of "INVALID WHEN USING, CONSUMING OR UNDER
THE INFLUENCE OF ALCOHOL OF ILLEGAL DRUGS" on professional, nonprofessional,
correctional officer and reserve peace officer permits to carry weapons
means any of the following: |
1.
|
The permit is not valid when the holder is in the act of using or consuming alcohol in any place and whether alone or in the company of others. The permit remains valid if the holder is in any place where alcohol is being consumed by others but not by the permit holder. |
2.
|
The permit is not valid when the holder is in the act
of using or consuming illegal drugs in any place. |
3.
|
The permit is not valid when the holder is under the influence of alcohol or illegal drugs. “Under the influence” is defined in the same manner as it is for operating a motor vehicle while under the influence of alcohol or drugs in §321J.2 of the Iowa Code. |
The restriction “VALID FOR HANDGUNS ONLY” will appear on nonprofessional permits to carry weapons. |
The restriction “ NOT VALID AS PERMIT TO ACQUIRE HANDGUNS IN IOWA” will appear on permits to carry issued to nonresidents of Iowa. |
