Officer Wishart was shot and killed by a man who was attempting to illegally dump rubbish in a graveyard. A man came to the graveyard with his workers attempting to dump rubbish and was informed by Officer Wishart that he was no longer permitted to use the graveyard for such purposes. The man drew two revolvers and shot Officer Wishart. Officer Wishart succumbed to his injuries July 1, 1891. The suspect was convicted of manslaughter.

Officer Wishart was married with 3 children. He was 54 years old.
